General Data Protection Regulation

As of this month, we are going to become much more careful when processing personal data.
The regulation is coming on 25th of May, and all European members must be compliant. Non EU countries have the same obligation if cooperating with EU members.
What does that means for EU companies?
Most of the companies still struggle with compliance. Many questions are how will we adopt our policies and documentations ? What about cookies? What about third party vendors (CRM´s and ERP´s, Cloud, or storage not located in-house), how do I know they are compliant? Do I need consent for all, and what about inbound and outbound marketing, newsletters, cold calls and more….
Those are the question we expect GDPR will make you ask, and here we are going to answer them all, not just for 25th, but afterwards as well.

Data Protection Officer

As much as we prepare it sometimes looks like it is a neverending story. Businesses turned on work in progress mode since last year. And now stands a very tall question, will the 25th of May mark the begining or the end of the GDPR compliant story?
Both. As we are probably all compliant by now, GDPR demands more. Documentation of storing and processing documentation, high security level, audit prepared, protection of personal data.
For future projects as well. It is the massive work, esspecially in companies with more then hundred employees sectioned into departments, proccessing daily a lot of informations, and data.
But this is not something that hasn´t been written so far. It is hard to create guidelines for companies in general to easy up the whole implementation and compliance part. Every company has its own number of staff, domain of work, managing board. It is helping a lot if you appoint a data protection officer. Data protection officer will as stated in the regulative, under Article 39 esction 1 and 2 perform following tasks:
to inform and advise the controller or the processor and the employees who carry out processing of their obligations pursuant to this Regulation and to other Union or Member State data protection provisions;
to monitor compliance with this Regulation, with other Union or Member State data protection provisions and with the policies of the controller or processor in relation to the protection of personal data, including the assignment of responsibilities, awareness-raising and training of staff involved in processing operations, and the related audits;
to provide advice where requested as regards the data protection impact assessment and monitor its performance pursuant to Article 35;
to cooperate with the supervisory authority;
to act as the contact point for the supervisory authority on issues relating to processing, including the prior consultation referred to in Article 36, and to consult, where appropriate, with regard to any other matter.
The data protection officer shall in the performance of his or her tasks have due regard to the risk associated with processing operations, taking into account the nature, scope, context and purposes of processing.
